TPG is a $222B private equity firm that owns many major brands including Airbnb, Spotify, McAfee, Chobani, DirecTV, Cushman & Wakefield, Exactech, and many more. Exactech manufactures and sells medical devices from its headquarter facility in the small college town of Gainesville, Florida, which is also home to the University of Florida Gators. For years, Exactech has had close ties to the University of Florida including, for example, its collaboration with orthopaedic surgeons in UF’s College of Medicine and the company’s sponsorship of UF’s on-campus indoor sports venue, the Exactech Arena. We have learned of numerous potentially serious incidences involving TPG/Exactech’s management that may be evidence of discrimination based on race, sex or sexual orientation, though the company’s governance proscribes such behavior. Shockingly, it appears after senior management was on notice of these acts, TPG/Exactech may have encouraged this behavior by not only failing to terminate many of these managers, but also by later promoting some of the same individuals who played a part in the acts. If true, it would seem the company is sending a very strong message that, despite its claims that is supports diversity, equity and inclusion, its practices in fact may support discrimination. We believe the details surrounding these and other incidences must be investigated as possible violations of the company’s own governance guidelines, and importantly, as potential violations of federal law. TPG/Exactech’s stakeholders, including its investors, employees, customers, surgeon consultant and customers, etc., deserve to know exactly what happened here because management has a responsibility to act in the best interest of its stakeholders. If our concerns are true and management knew of this behavior and encouraged it, we believe such irresponsible and reckless actions may expose the company to unnecessary legal and investment risk, which may have a material adverse effect on the company. For these reasons, we believe stakeholders are owed a more detailed explanation of management’s possible discriminatory acts. At this time, our focus is squarely on compiling the evidence needed to support potential civil and regulatory complaints and informing stakeholders and the public of the details of TPG/Exactech’s behavior. Current and former TPG/Exactech employees or other TPG employees have been a tremendous source of potential evidence of racial and/or sexual discrimination. This information is invaluable in documenting what we feel are in our effort to bring as we move forward with the gathering of potential evidence to support our anticipated lawsuit against TPG and Exactech. Though we have heard allegations of management using the N-word to make reference to Black employees, outing an employee as being gay, etc., acts that are much more subtle may be useful in a discrimination complaint.
May be overt and obvious: Demotion, passed over for promotion, disparate treatment, May also be more subtle such as the use of stereotypes.
Therefore, we encourage employees to report even the most subtle and seemingly insignificant act using the form below,even it he/she did not witness it direct. You can do so anonymously.
